Rights To Consent To A Search: Vehicle

1A.) Invalid Consent
-If the consent IS NOT Knowing AND Volunteering it is considered a Illegal Search.
-If you did not Volunteer to the consent it is Invalid.
-The consent has to be KNOWING. Law Enforcement have the option to either Decline or Accept the search.
1B.) Valid Consent
-The consent have to be Knowing AND Volunteering.
-For it to be considered a “Valid” or legal search the consent have to be (1) KNOWING AND (2) VOLUNTARY.
-Law Enforcement HAS to tell you that it is your RIGHT to refuse to Consent to a search.
-Law Enforcement HAS to tell you that the search is Voluntary in order for it to be considered Legal.

WHAT CAN YOU DO ?
1.) Ask to see a “Consent To Search Form” where you can read your rights and know them. and either Sign it Or
2.) Refuse to a search.

Keypoint : Was it a voluntary consent? Did you know your rights to refuse or consent?
BONUS (Why I'ts Important) : ANY possession(s) found during an “Illegal Search / Invalid consent” can not be used against (Will be DISMISSED) in the court of law.
